For users seeking personalized support, remote assistance is available for a fee, which must be paid in advance. Self-help options are also available, including tutorial videos and online chat support without remote access.

Please note:

• Remote support is only provided upon agreement to the applicable fee.
• The service reserves the right to refuse support if the required terms are not met.
• Personalized support does not guarantee successful email configuration, and clients are encouraged to use self-help resources.
• Liability disclaimers apply, and clients indemnify the service from any related claims or damages.

The service may update these terms without prior notice. By opting for personalized support, clients agree to adhere to the latest terms.

By using 911MYWEB services, you agree to the following:

• Do not use the services in violation of U.S. law.
• Do not infringe on the privacy rights of other users.
• Do not engage in or promote child sexual abuse.
• Do not engage in or promote content that is defamatory, harassing, or threatening.
• Do not engage in or encourage illegal activities or probe system vulnerabilities.
• Do not engage in activities that breach or circumvent security measures.
• Do not engage in content that harms other users or visitors.
• Do not promote or engage in obscene, pornographic content.
• Do not plant or distribute malware through the services.
• Do not infringe on intellectual property rights.
• Do not interfere with the operation of 911MYWEB services.
• Do not resell or use 911MYWEB services for commercial purposes without prior written consent.
• Do not engage in spam, hacking, or reverse engineering.
• Do not engage in activities that violate the Ryan Haight Online Pharmacy Consumer Protection Act or promote the sale of prescription drugs.

Prohibited Conduct: By using our services, you agree not to engage in any conduct, including but not limited to defamatory, false, misleading, or malicious statements, that could harm the reputation, business operations, or employees of 911MYWEB. This includes:

• Posting or spreading false, disparaging, or defamatory statements about 911MYWEB or its employees, partners, or clients.
• Engaging in any form of online or offline gossip, slander, or public accusations intended to damage the company's reputation or business relationships.

Liability for Harmful Conduct: You acknowledge that engaging in defamatory or harmful conduct could result in significant reputational and financial damage to 911MYWEB. Any user, visitor, or client found to be participating in such conduct will be subject to the following actions:

1. Account Termination: Immediate termination of access to our services without prior notice.
2. Legal Action: 911MYWEB reserves the right to pursue legal remedies, including claims for damages, costs, and attorney's fees, for any losses caused by defamatory conduct.
3. Indemnification: You agree to indemnify and hold harmless 911MYWEB, its employees, officers, and affiliates from any claims, losses, or damages, including reasonable attorney's fees, resulting from defamatory, false, or malicious statements made by you or in connection with your use of our services.

Public Statements: Clients agree to refrain from making public statements, online reviews, or comments that contain false, misleading, or defamatory claims about 911MYWEB. If you have a dispute, we encourage you to contact our support team to resolve the issue directly through our official channels.

Dispute Resolution Requirement: Before taking any public action, such as posting negative reviews or comments, you agree to notify 911MYWEB of your complaint and provide us with a reasonable opportunity to resolve the matter. Any failure to follow this process may be considered a breach of these Terms.

Legal Action for Defamation or Harmful Reviews: 911MYWEB reserves the right to pursue legal action against any individual or entity that:

• Publishes false, defamatory, or malicious reviews that damage the company's reputation or business interests.
• Engages in public smear campaigns with the intent to harm 911MYWEB financially or reputationally.
• Violates applicable defamation laws by posting or spreading statements that are knowingly false or misleading.

911MYWEB encourages open feedback and fair criticism of our services. However, statements that are knowingly false, defamatory, or intended to cause reputational harm are prohibited.

By subscribing to 911MYWEB services, you consent to the possibility that invoice notifications for recurring services may not be sent. Notifications may be provided before or after payments are processed. Through the client portal at 911MYWEB.com, you can view:

• All invoices
• Active services
• Communication history

You can adjust your notification settings in the client portal or by contacting support.

Payment Terms:

• All services must be paid in advance at the time of ordering or renewal.
• Accepted Payment Methods: Most major credit, debit, or prepaid cards are accepted.

Billing Details:

• An active payment method is required to maintain your account and services.
• Failure to maintain an active payment method may result in service interruptions or loss of domain names, emails, SEO rankings, or data.
• 911MYWEB is not liable for losses due to missed payments or failed automatic transactions.

Payment Information and Security: We use a secure bank merchant account to process credit card payments. When you provide your credit card information, it is securely transmitted to the payment processor and stored according to PCI-compliant security standards. We do not store your full card details on our servers. Instead, we retain a token provided by the payment processor to facilitate future payments. By using our services, you consent to the processing and storage of your payment information by the merchant in accordance with their privacy policy.

• This default method will be used for all future charges unless changed in the client portal.

Failure to Pay:

• If a payment is not processed successfully, we will attempt to use other saved payment methods.
• Services may be suspended or terminated if payments are not received.
• Reactivation fees of $75.00 may apply for reactivating services.

Refund Policy:

• All payments are non-refundable, including overdue or delinquent amounts.
• If a refund is authorized, it will be processed within 15 business days to the original payment method.

Automatic Payments:

• Services with recurring fees (monthly, quarterly, or annually) will auto-renew using the saved payment method.
• Users can update the default payment method through the client portal.

1. Grace Period: Customers are provided a 3-day grace period following the invoice due date. During this time, services will remain active and no late fees will be assessed. Payments submitted within this grace period will prevent the account from entering past-due status.
2. Late Fee Assessment: If payment has not been received after the 3-day grace period, a late fee of $15.00 will be applied on the 5th day past due. This fee will be added directly to the outstanding invoice and must be paid in full to bring the account current.
3. Service Suspension: Accounts that remain unpaid 8 days past the invoice due date will be subject to service suspension. Suspended services will remain inactive until all outstanding invoices, including any late fees, are paid in full. Additional reconnection or reactivation fees may apply where applicable.

If you, the client, believe you have been charged in error, received an incorrect invoice, or see a possible duplicate charge, you agree to contact us first to allow an opportunity for resolution before initiating a chargeback with your credit card issuer.

We are committed to resolving such matters quickly and fairly. In most cases, we can clarify misunderstandings and, if appropriate, issue a prompt refund.

Please note that if a chargeback is filed without prior contact, we may assess an administrative fee of up to $79.99 to cover related costs. Repeated or improper chargebacks may also result in the suspension or termination of services.

Nothing in this policy limits your rights under applicable consumer protection laws.

A standard processing fee of $15.00 applies to certain services and will be charged where applicable.

Website Restoration Fees:

• Restore Website After Suspension: $79.99
• Restore Website After Termination: $149.00

All restoration services require full payment in advance. Restoration is not guaranteed until payment is received and processed. Fees are non-refundable and subject to change without prior notice.

Important Notes:

• Website suspension or termination may occur due to non-payment, violations of our terms, or other administrative reasons.
• Restoration after suspension or termination is a manual process and may take up to 48 hours once payment is confirmed.
• 911MYWEB is not liable for data loss, SEO ranking impact, or any other consequences resulting from account suspension or termination.

By continuing to use our services, you acknowledge and agree to the fees and terms listed above.

Failure to Maintain Payments and Service Responsibilities: It is the client's responsibility to ensure timely payment of all fees associated with hosting, maintenance, domain renewals, or other services provided by 911MYWEB. Failure to meet these obligations may result in account suspension or termination, including the removal of the website and data from our servers.

Account Suspension: If the client fails to pay for services by the due date, the account may be suspended. Suspended or accounts that are overdue will have limited access to the website, client portal, and services until all outstanding payments are resolved.

Termination of Account and Deletion of Data: If the account remains unpaid or abandoned for 30 days or more, 911MYWEB reserves the right to terminate the account. Upon termination, all website data, configurations, and settings may be permanently deleted from our servers. This deletion may result in the loss of all files, data, and configurations, which may not be recoverable. 911MYWEB is not responsible for any data loss resulting from termination due to non-payment.

Notice of Termination: 911MYWEB will make reasonable efforts to notify clients of unpaid balances before termination through email or the client portal. However, failure to receive notice does not exempt the client from payment obligations.

Restoration Fees: If the client wishes to restore services after account termination, a restoration fee of $150.00 may apply, provided the data is recoverable. Restoration is not guaranteed if the data has been deleted.

Client Responsibility for Password Management:

• Client Control: The client is solely responsible for the safe storage and security of all passwords associated with their website, hosting, and any other services provided by 911MYWEB.
• Requesting Passwords: The client may request their current passwords at any time through our official support channels, provided proper verification is completed.

Password Resets:

• Manual Password Reset: Password resets will only be processed manually upon request if automated reset options are unavailable.
• Verification Requirement: Clients must provide adequate identification or proof of account ownership for manual password resets to protect account security.

Client Understanding of Future Service Needs:

• Ongoing Compatibility: The client acknowledges that, over time, the website may require additional services to maintain full functionality and visual optimization across new devices, including but not limited to computers, monitors, smartphones, tablets, and other emerging technologies.
• Optional Future Services: Any updates or optimizations required for compatibility with new hardware, operating systems, or display resolutions will be available upon request and may incur additional fees.

911MYWEB's Responsibility and Update Limitations:

• Completion Warranty: 911MYWEB guarantees the website's structure and performance for 30 days following the completion of development. After the 30-day period, the client assumes full responsibility for monitoring and maintaining the website's performance.
• Exclusion of Graphic and Structural Updates: After the guaranteed period, 911MYWEB is not responsible for performing free updates or modifications to the website's graphics, structure, or layout unless under a separate maintenance agreement.

Client Responsibility for Ongoing Monitoring and Updates:

• Monitoring for Issues: The client is responsible for monitoring the website for outdated content, disruptions, or performance issues caused by security patches, platform updates, or the release of new hardware and software.
• Impact of Updates and Market Changes: Clients acknowledge that new device versions, browsers, and software updates may affect how the website displays or functions over time, and additional services may be required to resolve these issues.
• Request for Services: If disruptions arise, the client may request troubleshooting, optimizations, or updates from 911MYWEB, which will be billed separately according to the scope of work required.

Repairs Made by Clients or Third Parties: 911MYWEB is not responsible for any damage, disruptions, or malfunctions caused by:

• Changes or repairs made by the client.
• Work performed by third parties, including subcontractors, personal hires, or individuals granted access by the client.
• Unauthorized modifications to the website or server configuration made by anyone other than 911MYWEB personnel.

• Optional Investigation Service: If damage occurs and the client requests an investigation, 911MYWEB offers professional services to determine the cause of the issue.
• Service Fees: Investigation and troubleshooting services will incur additional fees, which must be agreed upon before any work is initiated.
• No Guarantee of Repair: While 911MYWEB will make reasonable efforts to investigate and advise on potential solutions, we do not guarantee that all issues can be resolved, particularly if caused by third-party modifications.

Restoration Fees and Conditions: If a client's account is terminated due to non-payment, abandonment, or other violations of these Terms, the following restoration conditions apply:

• Web Restoration Fee: A non-refundable fee of $150.00 will be charged to restore the website if a backup is available.
• Backup Availability: Restoration is only possible if a recent backup exists. If no backup is available, 911MYWEB is not responsible for any lost data, and the restoration will not be possible.

Process and Timeline:

• Requesting Restoration: The client must submit a written request for restoration via the client portal or official support channels.
• Processing Time: Restoration requests will be processed within 5-7 business days from the time of payment, subject to the availability of backups.
• Additional Fees for Custom Work: If further reconfigurations or repairs are required beyond standard restoration, additional fees may apply, and the client will be notified in advance.

No Guarantee of Complete Recovery: While 911MYWEB will make reasonable efforts to restore the website, there is no guarantee that all data, settings, or customizations will be recoverable. Clients acknowledge that some data or content may be lost, especially if the termination has resulted in partial or full deletion from the servers.

Transfer Rights and Outstanding Fees: While the client owns the website and its content after full payment, 911MYWEB reserves the right to withhold or restrict the transfer of the website (including files, code, and configurations) to another hosting provider if there are outstanding hosting fees or any other unpaid service charges.

Hosting Fees Must Be Current:

• If the client maintains hosting services with 911MYWEB, all hosting fees and other service payments must be up-to-date before any transfer request can be processed.
• Suspension of Transfer Requests: Any request to transfer the website to a third-party hosting service will be denied if there are unpaid balances on the client's account.

Restoration of Transfer Rights Upon Payment: Once all outstanding fees are paid in full, 911MYWEB will release the website files for transfer within 5-7 business days and provide any necessary assistance to complete the process. No Transfer Liability: 911MYWEB is not responsible for any issues or data loss that occur during or after the transfer to a new hosting provider.

Non-Refundable Hosting Fees: Hosting fees already paid are non-refundable, even if the client decides to transfer the website before the end of the current billing cycle.

All copyrights for the services, designs, code, and other work performed by 911MYWEB will be transferred to the client upon completion of 100% payment for the service.

• Full Ownership Rights: Once the final payment is made, the client gains exclusive ownership of all deliverables, including any website content, code, and graphic designs created by 911MYWEB.
• Transfer Scope: This transfer grants the client the right to use, modify, and distribute the content without restrictions, subject to any third-party licenses incorporated into the project (e.g., plugins or stock imagery).
• Retention of Rights Prior to Final Payment: Until the full payment is received, 911MYWEB retains all ownership rights to the work and deliverables.

License Model for Proprietary Code: All software development and proprietary code created by 911MYWEB as part of your project is provided under a limited license. This license grants you, the client, the right to use the software and code exclusively for the domain name and project for which it was developed.

License Restrictions:

• No Resale or Sublicensing: You are not entitled to resell, distribute, or sublicense the software, code, or any other work developed by 911MYWEB without prior written consent explicitly outlined in a separate agreement.
• Single-Use License: The license covers only the specific domain associated with the project. Any additional use on other domains or projects requires a separate agreement and may incur additional licensing fees.
• Ownership of Code: While the code is provided under license for your use, 911MYWEB retains ownership of the proprietary code unless otherwise stated in a mutually signed agreement.

Amendments to License Terms: Any changes to the licensing terms, including permissions to resell or sublicense the developed code, must be expressly agreed upon in writing and outlined in a separate agreement attached to or referenced by these Terms.

Design Process: 911MYWEB will create a logo based on the client's requirements using either a handcrafted design or a template-based orientation. The final design will reflect the agreed-upon concept and direction provided by the client.

Trademark Disclaimer:

• No Guarantee of Trademark Registration: 911MYWEB does not guarantee that the logo will successfully be registered as a trademark.
• Legal Consultation Recommended: It is the client's responsibility to seek legal counsel to conduct a personalized trademark search or obtain legal advice regarding potential trademark conflicts.

Revision Policy:

• Included Revisions: The initial logo design includes up to three (3) revisions.
• Additional Revisions: Any revisions beyond the three included will be considered excessive and may incur additional fees.
• Redesigns: If the client requests a redesign or significant changes outside the original scope, it will be treated as a new service subject to separate fees.

Copyright and Ownership Transfer:

• Copyright Release Upon Full Payment: Once the client completes the full payment for the logo project, 911MYWEB will transfer all copyrights associated with the logo to the client.
• Ownership Rights: The client will have full ownership of the logo design and may use it as they see fit.
• Design Credit (Optional): 911MYWEB may request, but does not require, design credit to be attributed for the work. The client has the right to decline providing design credit.

1. Purpose of SMTP Services: The Simple Mail Transfer Protocol (SMTP) is essential for websites to send notifications, order confirmations, and form submissions via email. This applies to websites offering basic web presence or e-commerce functionalities. SMTP ensures smooth communication between the website and its users, administrators, and customers by delivering notifications promptly. Key uses of SMTP include:

• Order confirmations and notifications for online stores.
• Contact form submissions to administrators.
• Account creation, password resets, and other transactional emails.

Without a properly configured and functioning SMTP service, email notifications will fail, impacting the site's ability to deliver important communications to both site owners and users.

2. SMTP Account Requirements and Client Responsibility: The client is solely responsible for ensuring an active SMTP service to prevent failures in communication. Several options are available:

1. Purchase an email service from 911MYWEB for dedicated SMTP purposes.
2. Provide a compatible SMTP service linked to the same domain used for the website to ensure smooth delivery.

Clients must ensure the correct configuration and ongoing maintenance of the SMTP service. Failing to do so may result in contact forms, order notifications, and other email functions failing to deliver properly. 911MYWEB will not be liable for any issues caused by a non-functioning SMTP service.

3. SMTP Setup During Development:

• Temporary Setup by 911MYWEB: 911MYWEB may set up a temporary SMTP account during the development phase to ensure all email-based features are tested and working correctly.
• Invoice and Payment: If an SMTP service is required and set up by 911MYWEB, the client will receive an invoice for this service. If the invoice is not paid, the SMTP service may be suspended, resulting in email delivery issues.

4. Troubleshooting and Preventive Measures: To avoid issues, clients are encouraged to:

• Regularly monitor the SMTP service to ensure it remains active and configured correctly.
• Ensure that SMTP credentials (username, password, and host information) are always up to date.
• Check email quotas and limits with their provider to prevent message delivery failures.
• Use trusted email service providers to ensure compliance with SMTP protocols and avoid disruptions.

5. Consequences of SMTP Service Suspension:

• Impact on Email Functionality: If the SMTP service is deactivated due to non-payment or service cancellation, email notifications will stop, which may prevent order confirmations from reaching customers, block contact form submissions from being received, and disrupt password resets and other account notifications.
• No Liability for Disruptions: 911MYWEB is not responsible for any missed notifications or lost communications resulting from the failure to maintain an SMTP service.

6. Transfer and Migration Considerations: If the client transfers the website to another hosting provider, the client must ensure the SMTP service is properly configured with the new hosting provider and maintain ongoing access to email services to prevent interruptions. If SMTP service was provided by 911MYWEB during development, it will terminate upon website transfer, and the client will need to set up their own SMTP configuration.

7. Security and Compliance Recommendations:

• Use secure SMTP protocols (SSL/TLS) to protect emails from being intercepted.
• Implement rate limiting on outgoing emails to prevent the service from being flagged as spam.
• Verify that the SMTP server complies with anti-spam and email authentication protocols (such as SPF, DKIM, and DMARC) to ensure successful email delivery.

Scope of Services: 911MYWEB offers website and e-commerce design and development services tailored to the client's requirements. Services may include, but are not limited to:

• Custom website design and development.
• E-commerce platform setup and configuration.
• Integration with payment gateways, shipping services, and third-party tools.
• Mobile responsiveness and cross-browser compatibility.
• Initial SEO optimization (basic metadata setup).
• SMTP Account Setup

Project Deliverables:

• Design Approval Process: The client will receive design mockups or wireframes for approval before proceeding with development.
• Development Timeline: A project timeline will be established upon agreement, subject to change based on scope revisions or delays caused by client responses.
• Content Responsibility: The client is responsible for providing all content, images, and product details unless otherwise agreed upon in writing.

Revisions and Changes:

• Included Revisions: The initial project includes up to three (3) revisions during the design phase.
• Additional Revisions: Any revisions beyond the included number will be treated as extra services and may incur additional charges.
• Scope Changes: Significant changes to the project scope or additional features requested by the client after the development phase begins will be billed separately.

Client Responsibilities:

• Content Delivery: The client must provide all necessary content (text, images, product details) promptly to meet the agreed timeline.
• Testing and Feedback: The client agrees to test the website thoroughly upon completion and provide feedback within the warranty period (30 days).
• Ongoing Maintenance: The client is responsible for maintaining the website and ensuring timely updates unless a separate maintenance agreement is in place.

Payment Terms:

• Payment Milestones: Payment schedules and milestones will be outlined in the project agreement.
• Full Payment Requirement: The project will be considered complete after the project reaches 75% or more only after the full payment is received. Any outstanding payment may result in suspension of services.
• Non-Refundable Payments: All payments for design, development, and e-commerce services are non-refundable.

Website Ownership and Transfer of Rights:

• Copyright Transfer: Upon receipt of full payment, 911MYWEB will transfer ownership of the website (excluding licensed third-party software) to the client.
• Hosting Transfer: If the client requests a transfer to a new hosting provider, all outstanding fees must be paid before the transfer process begins.
• Third-Party Licenses: Any third-party tools or plugins integrated into the website are subject to their own licensing terms.

Warranty and Post-Launch Support:

• 30-Day Warranty: 911MYWEB provides a 30-day post-launch warranty for bug fixes and performance issues related to the original project scope.
• Exclusions: The warranty does not cover issues caused by third-party software, client modifications, or changes made after launch.
• Additional Support: After the 30-day period, support services will be available upon request.

E-commerce Platform and Payment Integration:

Full Payment Discount: Clients who choose to pay in full benefit from a discounted price for the service compared to those using the installment plan.
3. No Eligibility for Special Promotions: Installment plan clients are not eligible for special promotions or discounts available only to full-payment clients. However, they benefit from the extended payment period without incurring additional charges or interest.

Non-Cancellation and Payment Obligation: Clients using the installment plan remain obligated to complete all scheduled payments in full, even if they decide to cancel the service or alter the project's scope during the installment period. Post-Development Hosting and Transfer Options: Upon project completion, the client may choose to: (a) Continue hosting with TIPIHOST.com and receive a 90-day extended warranty for fixes and updates, or (b) Transfer the website to another hosting provider of their choice. Warranty Limitation on Transfer: If the client transfers the website to a third-party hosting provider (other than TIPIHOST.com), the 90-day extended warranty will be voided on the day of transfer.
5. Conditions for Website Transfer: The client must complete all payments in full for the web development service before any transfer occurs. All associated services, including web hosting, email services, and SSL certificates, must be active and in good standing, with no past-due or overdue payments.

The Client is responsible for deciding whether or not to use AI tools. 911MYWEB does not provide guidance, training, or advice on how to use AI, unless explicitly specified as a separate service in the invoice.

The Client may use tools such as ChatGPT or Google Gemini before placing an order to help plan their project. By placing an order and making payment, the Client confirms that all requirements, ideas, and expectations, including any AI input, have been reviewed and finalized.

The agreed project scope includes a reasonable number of revisions, as discussed at the start. These revisions are intended to adjust and improve the original work, not to introduce new ideas, redesign the project, or change the overall direction.

Any new ideas, suggestions, or feedback—whether from AI tools or personal preference—shared after the project has started or been completed are not automatically included in the original scope of work.

If additional changes are requested outside the agreed scope, including those based on AI suggestions, they will be treated as new work. These requests may require additional time, cost, and approval, and will be addressed after the current scope of work is completed.

Once work has been approved, it will not be reopened for ongoing or repeated changes based on new or evolving AI or personal preference feedback. All additional requests and approaches remain subject to the approval of 911MYWEB.
